In a recent Appeals Tribunal (WSIAT) decision, a police officer who, on off-duty time had gone to visit his parents in Sudbury, was injured while leaving his parent's home. At the time he was on his way back to Toronto in order to attend a court appearance. The WSIB held that since he was on his own time, and had taken himself out of his own home in order to travel to Sudbury, his injury did not arise in the course of his employment.

On appeal to the Appeals Tribunal, the panel held that to interpret the Board's policy as requiring officers on lieu or vacation time to spend the evening before a court appearance at home, was unduly restrictive. The panel ruled that the officer's injury in Sudbury arose out of and in the course of his employment.
